iTalegal Law Team has its roots in the second decade of the last century, when Silvio Marzari Senior (1886-1967) started to practice as an advocate (avvocato). He went on to become a judge, and reached the peak of his career as Chief Public Prosecutor (Procuratore Generale) at the Court of Cassation in Rome.

 

Silvio Marzari Junior has continued the family's legal tradition, and thanks to his academic experience at Italian and foreign universities, he re-founded the law firm focussing primarily on civil and commercial law - with particular reference to international private law and procedure, as well as EU legislation, and more generally, relations with other countries; more specifically, Germany, Austria, Switzerland, the UK, the USA, Brazil and other Latin-American countries, as well as the Far East. 

 

Avvocato Roberto Nicolini, the Vice President of AEA International, specialises in commercial law, banking law, private international law and procedure, as well as property law. He represents foreign companies, in particular assisting German and other foreign countries’undertakings develop their businesses in Italy, and Italian firms in their relations and litigation overseas, working in both German and English.  He also assists clients with international inheritance and succession issues.

1) Know your enemy. In any case, but especially before starting a civil case, it is important to gather information on the financial and asset situation of the other party. If it is in financial difficulties, there is no point in starting a lengthy lawsuit at the end of which it may have gone bankrupt, but it may be more advantageous to waive part of the claims and sign an out-of-court settlement right away.

 

2) Focus on the key person. Especially with the counterparty, they always focus on understanding who the decision maker is in order to get messages across to him during our negotiations. It is therefore important to understand how the counterparty's team is composed in order to set the strategy correctly in business negotiations, as well as in litigation.

 

3) Avoid all possible stamps and formalities. In international law it often seems that there are insurmountable linguistic and cultural difficulties in enforcing one's rights. They work together also and above all with our lawyer partners in other countries, and make maximum use of all existing international agreements and bilateral conventions to make documents easier to use in the other country without the need for costly and cumbersome formalities. 

 

The lawyers in iTalegal Law Team have all spent part of their professional training abroad, and most of them work fluently not only in Italian but also in English and German, with specific reference to transnational business operations in their respective areas of civil and commercial law, including company law questions such as acquisitions and mergers, transnational inheritance issues, intellectual property, negotiation and drawing up of contracts, including supply, distribution and franchise agreements, agency and transport agreements, real estate issues, arbitration, bankruptcy and related insolvency procedures.
